In a move to address financial challenges faced by counties across New York, Senator Mark Walczyk and Assemblyman Ken Blankenbush have introduced legislation (S8448) to increase the reimbursement rate for localities housing “state-ready” inmates. These are individuals sentenced to state prison but currently residing in county jails awaiting transfer.

New York State has maintained a $100 per inmate per day reimbursement rate since 1988, which many argue does not reflect current costs. St. Lawrence County has reported losses exceeding $300,000 due to delays in transferring these inmates. Sheriff Engle expressed frustration over the financial strain this causes: “Counties are losing significant resources while waiting for the state to take responsibility.”

The proposed bill would raise reimbursements to $300 per day per inmate for the first ten days and $600 thereafter, or cover actual costs if higher. Assemblyman Blankenbush is championing this bill in the Assembly. Senator Walczyk emphasized the need for change: “It’s clear that the state is shifting costs onto counties, saving itself about half a million dollars a day.” He added that the bill aims to provide financial relief and expedite transfers.

Assemblyman Blankenbush echoed these concerns: “Unfunded and underfunded mandates have become New York State’s favorite punishment for our hardworking county governments.” The legislation seeks to alleviate these burdens while ensuring necessary services for inmates during their time in county facilities.

Sheriff Mike Carpinelli of Lewis County thanked Walczyk and Blankenbush: “This legislation will help ease the burden on Lewis County taxpayers and help keep residents safe.” Jefferson County Sheriff Peter Barnett also supported it, saying it’s long overdue for attention.

Herkimer County Sheriff Scott Scherer endorsed the proposal as addressing an urgent need: “It’s time for the state to step up and fulfill its responsibilities.” Oswego County Sheriff Don Hilton stated his full support, emphasizing public safety concerns.

Fulton County Sheriff Rich Giardino commended Walczyk’s efforts, noting that current reimbursement is inadequate. Hamilton County Sheriff Karl Abrams agreed, saying it’s high time taxpayers received relief from these financial strains.
